By accessing or using InItPic ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

InItPic is a photography marketplace that connects event photographers with attendees using AI-powered facial recognition technology. The Platform enables:

Photographers to upload, manage, and sell event photos.
Customers to find photos of themselves using selfie-based facial matching.
Secure purchases and digital delivery of full-resolution photos.

3. Account Registration

To access certain features, you must create an account. You agree to:

Provide accurate and complete registration information.
Maintain the security of your account credentials.
Accept responsibility for all activity under your account.
Notify us immediately of any unauthorized use.

4. For Photographers

Photographers using the Platform agree to:

Upload only photos they have the legal right to sell and distribute.
Ensure they have appropriate permissions or model releases where required.
Not upload content that is illegal, offensive, or violates others' rights.
Accept the Platform's commission structure and payment terms.
Maintain professional standards in their interactions with customers.

5. For Customers

Customers using the Platform agree to:

Use purchased photos for personal, non-commercial purposes unless otherwise agreed.
Not redistribute, resell, or sublicense purchased photos without photographer consent.
Provide accurate selfie images for facial matching purposes only.
Respect photographers' intellectual property rights.

6. Purchases and Payments

All transactions are processed securely through Stripe. By making a purchase, you agree to:

Pay the listed price plus any applicable taxes or fees.
Provide valid payment information.
Our refund policy as outlined in these terms.

Photographers receive payouts according to the Platform's payment schedule, minus applicable platform fees.

7. Refund Policy

Due to the digital nature of our products, refunds are handled on a case-by-case basis. Refund requests may be submitted within 14 days of purchase. We may issue refunds for:

Technical issues preventing photo download.
Significant quality issues with the delivered photo.
Incorrect photo delivery due to matching errors.

8. Intellectual Property

Photographers retain copyright ownership of their photos. By uploading to InItPic, photographers grant us a license to display watermarked previews and facilitate sales. Customers receive a personal-use license upon purchase.

9. Facial Recognition Consent

By using our facial matching features, you consent to the processing of your facial data as described in our Privacy Policy. You may withdraw consent at any time by deleting your selfie from your account settings.

10. Prohibited Conduct

You agree not to:

Use the Platform for any unlawful purpose.
Upload malicious content or attempt to compromise Platform security.
Scrape, crawl, or harvest data from the Platform.
Impersonate another person or misrepresent your identity.
Circumvent watermarks, access controls, or security measures.

11. Limitation of Liability

InItPic is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability is limited to the amount you paid to us in the twelve months preceding the claim.

12. Termination

We may suspend or terminate your account for violation of these Terms. You may close your account at any time. Upon termination, your right to access the Platform ceases, but provisions regarding intellectual property and liability survive.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the new Terms.
